Standing Up for Injured Moped Riders in Dallas

As mopeds and scooters increase in popularity, so do the chances of accidents. Other drivers must be especially careful while driving among motorized bikes and scooters. Unlike cars, which offer the protection of crumple zones, seatbelts, and other types of safety features, mopeds are far more exposed and vulnerable in the event of a collision.

If you were struck by another vehicle while riding your moped, our team of Dallas motorcycle accident attorneys at The Lenahan Law Firm will work on your behalf to reach a successful outcome to your case. Contact our office today at (214) 295-1008 to learn more and receive a free consultation.

How Does Texas Law Regulate Mopeds?

Texas defines any scooter with an engine larger than 50cc as a motorcycle, while any vehicle with a 50cc engine or less is categorized as a moped. The majority of accidents involving motorcycles, mopeds, and scooters occur at intersections. Car and truck drivers must be on high alert at all times, especially while crossing intersections, since they may not see a moped while making a left turn or other type of maneuver.

Other dangers that moped riders face:

  • Getting rear-ended by a car because the driver did not keep enough distance between vehicles.
  • Being “merged into” when another driver failed to check his blind spots.
  • Dangerous weather conditions, which increase the likelihood of a crash.

Texas law states that moped drivers must adhere to current helmet laws and operate their vehicles only on roadways while under the speed limit of 30 mph.

What Are the Dangers of Riding a Moped?

Like scooters, bicycles, and motorcycles, mopeds have an inherent disadvantage when out on the road in terms of safety. Drivers around moped riders should consider the following:

  • Visibility. Because a moped is a particularly small vehicle, not all drivers have a clear view of where the moped is at all times. This is especially true of buses, SUVs, trucks, and other larger vehicles. Moped drivers should try to avoid the blind spots other vehicles and keep a fair amount of distance between themselves and other cars while out on the road, when they can.
  • Night driving. Again, the small size of the vehicle is a definite factor, especially at night. The size of the vehicle combined with smaller headlights means that other drivers must be alert in dim-light conditions. Studies shows that moped accidents most often occur in low or dark lighting, making it very important for drivers to be hyper-alert at this time of the day.
  • Pay attention. Distracted driving is an epidemic on Dallas streets. While mopeds do have the advantage of being able to pass by other cars in slow traffic, the drivers of these vehicles may not be paying attention and may try to merge into or in front of the moped.
  • Road design. Some roadways are not designed to support the movement of mopeds. Most moped accidents occur in rural areas and at speeds over 20 miles per hour.

If another driver struck your moped or caused you to crash, you may have a valid claim for compensation.
